Terms and conditions of sale

Article 1: Introduction

WOOMEN.EU is a brand owned by the simplified joint stock company REFLEX.

These General Terms and Conditions of Sale constitute the entire set of provisions forming the offer made by REFLEX, a simplified joint-stock company with a capital of €100,000, whose registered office is located in BAILLEUL (59270), registered with the Dunkerque Trade and Companies Register under number 522 043 348, VAT identification number FR66 522 043 348, hereinafter referred to as "REFLEX" or "we," intended for any potential purchaser of its products via the website www.woomen.eu, hereinafter referred to as the "user" or the "customer."

By placing an order, the customer fully and unconditionally agrees to these General Terms and Conditions of Sale. Any contrary condition set by the customer is not opposable to REFLEX. REFLEX cannot be contractually bound by any document other than these General Terms and Conditions of Sale, including brochures or catalogs, which are provided for informational purposes only. REFLEX reserves the right to modify these General Terms and Conditions of Sale at any time.

Any customer may consult the General Terms and Conditions of Sale at any time on the website www.wommen.fr (hereinafter "the site"). Since these terms and conditions may be subject to modifications, the applicable conditions are those in effect on the site at the date the order is placed.

Any reproduction, in whole or in part, is strictly subject to authorization by REFLEX.

These general terms and conditions of sale are intended to define the terms of sale between REFLEX and the user, from order to services, through payment and delivery. They goven all the steps necessary for the placing of the order and ensure the follow-up thereof between the contracting parties.

Article 2: Acceptance of Terms

The client acknowledges that they has read, at the moment of the order, the Terms and Conditions of Sale as explained in this document and formally declares to accept these in full.

Article 3: Products

The characteristics of the products ordered by the customer are indicated on the 'Products' pages of the website. All products offered comply with current French legislation and the applicable standards in France.

Some products are guaranteed by the supplier (see product sheet) against manufacturing defects, but not against normal wear and tear due to regular use or misuse of the product.

The photographs illustrating the products are provided for illustrative purposes only.

Our products are offered within the limits of available stocks.

The products remain the property of REFLEX until full payment of the price has been made.

REFLEX cannot be held liable in case of non-compliance with the legislation of the country where the product is delivered.

The products are described and presented as accurately as possible. However, in the event of minor errors or omissions in this presentation, REFLEX cannot be held responsible.

Article 4: Price

Prices are indicated in euros, including all taxes. They take into account the value-added tax applicable on the day of the order, excluding handling and delivery fees.

We reserve the right to change these prices at any time, but products will be billed based on the prices in effect at the time the order is placed.

Prices are only valid on the woomen.eu website and may differ from those displayed in stores operated by REFLEX for similar products.

REFLEX is committed to guaranteeing you the best price. If within 10 days of purchasing an item on the woomen.eu website you find the same item at a lower price on another French website, we agree to refund you twice the difference, subject to the following conditions being met :
The product must be identical: it must be new, of the same brand and model, and have the same reference, color, and size.

  • It must be sold in the same quantity and cannot be compared to products sold in bundles.
  • The cost of the offered service, including additional fees such as shipping, packaging, administrative fees, etc., must be equivalent. The product must be immediately available.
  • The delivery time must not exceed that offered by woomen.eu
  • The product must be genuinely for sale. For example, promotional offers intended only to attract consumers without actually offering the product for sale will not be considered.
  • The product must be sold outside of sales, promotions, or clearance events and must not be subject to a discount via a promotional code. The product must not be sold on an auction or classifieds website.
  • It must be delivered within mainland France.

If all of the above conditions are met, REFLEX undertakes to refund you twice the difference by bank transfer within one month from the receipt of your request. Only one refund will be granted per customer for the same item, and only after the customer has provided the following information :

  • Their first name and last name
  • Their order number
  • The item reference on the woomen.eu website
  • The price amount on woomen.eu
  • The name of the website and the webpage where the lower price is found

Article 5: Order

Orders are placed through the website and can only be registered if the user has clearly identified themselves by entering their email address (or their specific woomen.eu user ID) and their password, both of which are strictly personal.

The contractual information is presented in English and will be confirmed at the latest at the upon of delivery. We reserve the right to cancel or refuse any order from a customer with whom there is an ongoing dispute regarding the payment of a previous order.

Any order implies acceptance of the prices, these general terms and conditions of sale, and the description of the products available for purchase. Any dispute on this matter shall be addressed within the framework of an exchange, a return, or the warranties mentioned below.

In the case of an order placed by a professional, REFLEX shall not be held liable for any indirect damages arising from these terms, loss of business, loss of profit, loss of opportunity, damages, or expenses that may result from the purchase of the products.

Article 6: Validation

In compliance with the Law no. 2000-230 of March 13, 2000, concerning the adaptation of law of proof to evidence to information technologies and relating to electronic signatures, the online submission of the credit card number and the final validation of the order constitute irrevocable acceptance of the general terms and conditions of sale and payment. It also assumes that every transaction has been checked by REFLEX and its client, and serve as proof for the totality of the mentioned order and for the monies due as detailed on the purchase order. This validation constitutes express acceptance of all operations carried out on the website.

Every order will be confirmed by REFLEX by email to the client, once the order has been validated or at the latest when the moment the order is being shipped.

In case of misuse of a bank card, the client will be asked to contact our customer services department immediately when this fraudulent use comes to light.

Article 7: Availability

Unless otherwise stated, our product offers are available while stocks last. In the event of non-performance of the contract due to the unavailability of the ordered item, the customer will be informed of this unavailability by email. The order will be canceled, and the customer will be refunded, according to REFLEX's choice of payment either by a credit to their bank account, no later than 30 days after the order payment (date of credit to our bank account).

Article 8: Delivery

The products purchased on the site are delivered to the address indicated by the customer during the order process. As an indication, the average delivery time is 4 working days for mainland France.

In the case of payment by credit card, the deadlines indicated are average deadlines and correspond to the average shipping time added to the average delivery time.

Our carrier will deliver from Monday to Saturday at the address you have indicated.

It is your responsibility to check immediately upon receipt of the package for its condition, the good condition of the item ordered, as well as its conformity with the order. In all cases, you have a period of three (3) days, not including holidays, from the receipt of your package to notify the carrier, by extrajudicial document or registered letter, your reasoned protest (article L133-3 of the Commercial Code).

REFLEX must execute the order within 30 days from the day following that on which the customer validated their order. The exceeding of the shipping time, may not give rise to any cancellation of the order, no reduction of the price paid by the buyer and no payment in damages, when the customer is delivered within 30 working days of the confirmation of their order.

REFLEX is responsible for the proper performance of the contractual obligations towards the customer and resulting from the contract concluded on the site. However, REFLEX may release itself from all or part of its liability by providing evidence that the non-performance or poor performance of the contract is attributable either to the customer or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure as defined by the French jurisprudence in force, disturbances or general strike, total or partial, especially postal services and means of transport and/ or communication, flood, storm, fire.

Similarly, REFLEX cannot be held responsible in the event of non-performance of the contract due to stock shortages or unavailability of the product.

Finally, REFLEX cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, including a breakdown of service, an external intrusion, the presence of computer viruses.

In the case of delivery at a relay point, the carrier may deliver the package to a pickup point other than that requested by the customer (for example: following the closure of the latter for any reason), REFLEX will not be held responsible.

In case of a new delivery of an order, especially due to a delay in the initial delivery. REFLEX will send the customer a certificate prior to the new delivery, including acknowledgement by the latter of the lack of receipt of the initial delivery, his refusal to receive the order or return it within 10 days of its receipt and failing a return within this period, it’s authorization to debit the amount of the order related to the new delivery. The new delivery will be sent to the customer upon receipt of this completed and signed certificate.

If the customer claims not to have received the product ordered while REFLEX claims to have delivered it, the customer must file a complaint with REFLEX customer service. His claim must be justified, signed and accompanied by the supporting documents of the damage suffered (purchase invoice, filing of complaint, a sworn statement of non-receipt of the package, copy of ID). It is the customer’s responsibility to send this file containing the completeness of the supporting documents within fifteen (15) working days following the opening of the dispute with the REFLEX customer service, in order to claim a possible refund. In the case of an incomplete file, no refund can be made unless the sale of the product is resolved under the conditions of article L.216-2 of the French Consumer Code.

Article 9: Payment and security

Payment of your purchases will be made online on the site by credit cards: Visa, MasterCard or Paypal.

The security system implemented for transactions is handled by the company INGENICO formerly OGONE (www.ogone.fr). Personal information and credit card numbers are never transmitted in clear text between the browser and the server. Data is signed, encrypted, and transmitted using the SSL protocol (SSL Certificate) before the payment module. The approval from the central credit card network (the central credit card network) triggers the acceptance of the order. Your account is debited with the amount of your invoice corresponding to the product(s) shipped(s) and the shipping costs, after the agreement of the central network of bank cards.

The customer’s choice of another payment method must be subject to prior agreement by REFLEX.

In the event of fraudulent use of a credit card or other payment method, we reserve the right to suspend the dispatch of your order and request payment by bank transfer only.

For the order analysis system (fraud detection) :
The information related to your order is subject to automated data processing. This automated processing of data aims to define a level of analysis of a transaction and to combat fraud on credit cards and other payment methods.

In accordance with the law N°78-17 Informatique et Libertés of January 6, 1978 you have, at any time, a right to access, modify, rectify and oppose all your personal data by writing, by mail to the address of REFLEX indicated providing of your identity.

Article 10: Shipping costs

Unless otherwise stated on the site and with the exception of orders for sale items, promotional products or those with a guaranteed low price, shipping costs are free for any order above 39 euros, including taxes, delivered in metropolitan France, Corsica, and Belgium through the Mondial Relay pickup points.

Free delivery to a Mondial Relay pick-up point also applies to any order consisting exclusively of promotional products, or guaranteed low price items totaling more than € 59 including taxes, for delivery in metropolitan France, Corsica and Belgium.

REFLEX reserves the right to change these rates at any time. Below these amounts, a shipping fee will be charged.

Article 11: Right of Withdrawal

The customer has 30 working days from receipt of the product to withdraw, without having to justify or pay penalties. The product must be returned to us within 30 business days from the date the withdrawal decision is communicated. No shipment will be made before receipt of payment for the order, regardless of the reason.
REFLEX refunds the full amount paid by the customer, except for return shipping costs which remain the customer's sole responsibility, within a period not exceeding 14 days from the date it was informed of the right of withdrawal.

However, REFLEX may delay the refund until it has received the product back or until the customer has provided proof of shipment, whichever occurs first.

The product must be returned in its original condition and complete (packaging, accessories, etc.) and accompanied by a copy of the invoice and the duly completed return form. Incomplete, damaged or spotted product will not be accepted for return.

For a period of 30 days from the date of communicating their withdrawal decision, the customer can return the product free of charge by dropping off their package exclusively at a Mondial Relay pick-up point. To initiate a return, the customer must access the MY ACCOUNT section, choose the corresponding order, and click on RETURN REQUEST. They must select their order, choose a Mondial Relay pickup point and print a return slip that they will affix to his package. Then, they must drop their package at the Mondial Relay pickup point. The costs of printing the return slip and depositing the package at the Mondial Relay pickup point are not covered by REFLEX. Upon receipt of the package by REFLEX, it is processed within 5 working days. Any return sent outside of this procedure will be at the exclusive risk and expense of the customer.

Notwithstanding the return reason chosen by the customer, only one return per order is allowed even if the order contains multiple products.

Article 12 : Returns – Refund

Aside from the return case specified in Article 11, if the product does not match your order or is defective, it must be returned within the applicable time frame for the legal conformity warranty and the legal warranty against hidden defects, starting from the date of receipt, to REFLEX – Parc d’activités de la Verte rue – 432 Allée des prêles à Bailleul (59270) - France, in its original and complete condition (packaging, accessories, etc.), along with a copy of the invoice and the duly completed return form.

The incomplete, damaged or soiled product will not be accepted for return.

REFLEX will refund the full amount paid by the customer through the payment method used for the purchase, provided the legal conformity warranty applies or the product
cannot be repaired or replaced, within a period not exceeding 14 days from the date REFLEX receives the returned product.

The customer must place a new order if they wish to receive the product corresponding to their original order.

For a period of 30 days from the date the product was shipped by REFLEX, the customer can return it free of charge by dropping off their parcel exclusively at a Mondial Relay pickup point. The customer must go to the MY ACCOUNT section, access the Order History, and click on REQUEST RETURN. The customer should then drop off the parcel at the selected Mondial Relay pickup point. REFLEX does not cover the cost of printing the return label or depositing the parcel at the Mondial Relay pickup point. Upon receipt of the package by REFLEX, it will be processed within 5 business days.

Notwithstanding the return reason chosen by the customer, only one return per order is allowed even if the order contains multiple products.

Article 13: Personal data

REFLEX commits to not disclosing to third parties the information provided by users on the site. This information is confidential. It will be used exclusively by its internal departments for processing your order, for enhancing and personalizing its communication, particularly through newsletters and informational emails, and for personalizing the website according to the preferences observed among customers.

The data collected on the site is for internal use only and are included in our customer database. REFLEX refuses to disclose this data to any company, except for the companies belonging to the group to which REFLEX SAS belongs.

In accordance with Law no. 78-17 on Information Technology and Civil Liberties of January 6, 1978, the customer has the right to access, modify, correct, and oppose the processing of the data recorded about them. This right to correction can be exercised at any time by sending a letter to the address of the company REFLEX indicated below :

Article 14: Intellectual property

Any text, comments, artwork, illustrations and photos published on the website are copyright protected with regard to the author, the brand, design and image. They remain in their entirety the property of REFLEX.

As such, and in accordance with the law on intellectual property, only private use under certain circumstances, which are more restrictive than the law on intellectual property, is authorized.

Any other use will be regarded as plagiarism and treated as an unauthorized use of intellectual property, if no prior consent has been provided by REFLEX.

Any copying, in its entirety or partially, of the site catalogue is strictly prohibited.

Article 15: Applicable law – Litigation

REFLEX's liability cannot be engaged if the non-performance of its obligations is due either to an unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure as defined by French case law. Likewise, REFLEX shall not be held liable for any inconveniences or damages inherent in the use of the Internet network, including service interruptions, external intrusions, or the presence of computer viruses.

Similarly, REFLEX cannot be held responsible, towards a user or any third party, for any indirect damage, loss of business, profits, or turnover, regardless of how they occur, even if such damage, loss, or prejudice was foreseeable by REFLEX or if its possibility had been brought to its attention.

In the event of a dispute and failing an amicable settlement, the French courts shall have sole jurisdiction.

Article 16: Legal guarantees

All products supplied by REFLEX are covered by the legal guarantee of conformity provided for in Articles L.211-4 to L.211-14 of the consumer code, or by the warranty against hidden defects provided for in Articles 1641 to 1649 of the civil code.

Article 17: Changes to the General terms and conditions of sale – Complaints – Customer Service

REFLEX reserves the right to modify the terms and conditions of sale and use at any time.
